TERMS AND CONDITIONS OF MEMBERSHIP
THE AGREEMENT:
1. Members of this Spa & Wellness space are
bound to the terms of conditions of the membership outlined below. Abiding by
the rules is to guarantee the safe usage of the facilities and ensuring
enjoyment by all members. Anantara The Marker Dublin Hotel processes the sole responsibility for the
operation and control of the Spa & Wellness space. Anantara The Marker
Dublin Hotel is within its right to amend the
facilities, policies, or procedures at its sole discretion.
2. Membership refers to usage of the Wellness
facilities at Anantara The Marker Dublin Hotel . The Spa
treatment rooms and relaxation area are not included in this membership.
“Member” refers to the user of the facilities and abider of the “rules” which
are listed below set out by Management of the Spa & Wellness department.
MEMBERSHIP:
3. We advise all our members to become aware of
the code of conduct in relation to membership that is displayed in the Spa
& Wellness area.
4. Membership options and rates are available
at the Spa and Wellness Reception Desk
5. Unless indicated otherwise, all
correspondence shall be sent by the management team, electronically, to the
email notified to us by you.
6. Any notification to us from you must be in writing.
7. Benefits issued with membership are
non-transferable, cannot be used as a cash alternative or transferred to
another person. Benefits must be used whilst the membership is active and
within a 12-month period.
8. Amendments and cancellation of these
benefits are at Management’s discretion.
9. Guests using guest passes must be always
accompanied by the member.
10. Membership will run concurrently without disruption.
11. We may offer promotional membership which
will be at our own discretion.
12. You will be issued with a membership card
that will remain the property Anantara The Marker Dublin Hotel . Membership
cards are nontransferable, and their loss should be reported to reception
immediately. Upon termination of your membership, you will be required to
return your membership card to us.
13. Misuse of membership cards will result in
immediate termination of your membership.
14. Cancellation of membership must be given in
writing to Management with a 30-day notice period. There are no acceptations
made to the notice period for cancellation or how it is to be provided.
FEES AND SUBSCRIPTIONS
15. An advance payment of membership must be
paid in full for the length of membership purchased. Membership commences from
the day the membership is paid for.
16. Your membership will be valid for the period
of membership purchased. After which time we will ask you to renew your
membership or apply notice of cancellation.
17. Fees may be varied throughout the year.
However, this will not affect current membership. The rate changed would be
applied on the next renewal date.
18. Guests of members may be brought in to use
the facilities for a fee of €25 per child & €35 per adult.
GROUNDS FOR ENDING THIS AGREEMENT
19. You seriously or repeatedly break or ignore
the rules of the membership and cannot reverse your actions upon notification
from Management. Such a breach will see a new application for membership being
denied and refusal of membership in any other facility operated by this organization.
20. Knowingly permitting use of your membership
card by another person.
21. If the Spa and Wellness space should be
closed indefinitely, we will endeavor to inform you electronically with a
notice period of 30 days.
22. If you or your guest is abusive, rude,
causes disruption or unease through violence or abusive language, which in turn
would disturb the enjoyment of other in the Spa and Wellness space or cause
unease to our staff will we give you 30 days’ notice on your membership. Any
action by a member or their guest that will see the good name of any facility
within The Marker Hotel being tarnished will ensue a notice period of 30 days
on the membership.
23. Management have the right to amend the terms
and conditions of membership as well as the conditions as they see fit.
SUSPENDING MEMBERSHIP:
24. Memberships may be suspended for periods
between three and twelve months for medical reasons. Application to defer
membership must be given in writing to Management 14 days prior to the
commencement date and must be accompanied by a letter from your Doctor stating
due to medical reasons you are unfit to use the facilities. Suspension will
commence on the first day after the 14 day notice period had ended. If your membership
is to be suspended for a period greater than 3 three months additional
confirmation from a medical professional may be required after every 30-day
period. Suspension may be terminated, and the membership will commence again if
such needs are not met.
25. Exceptions may be made to the above
situations in regard to suspension of membership; however, this is wholly at
the discretion of Management and must be agreed in writing.
26. Entry into the Spa and Wellness space whilst
your membership is suspended is strictly forbidden
CODE OF CONDUCT:
27. Photography is strictly forbidden within the
Spa & Wellness. Cameras and mobile phones devices are not permitted for use
anywhere but the gymnasium where they can be used in conjunction with the
equipment/ music.
28. Appropriate attire must be worn at all times
in the Spa & Wellness. Swimwear is required within the pool area and
correct fitness attire is required in the gymnasium. Exercising without
footwear is not permitted.
29. Running, diving or jumping into or around
the hydro pool is prohibited. There is no lifeguard on duty in the pool area.
30. Use of the Spa and Wellness is forbidden
after the consumption of alcohol, illicit substances and any other medication
that impairs consciousness or concentration. Glass bottles are not permitted on
the pool deck.
31. Eating is strictly prohibited in the pool,
steam, and sauna areas. This rule is in place to maintain a clean and
hygienic environment for all guests. We kindly ask that you refrain from
consuming any food in these areas.
32. Guests or members who have been ill within
the last 7 days are discouraged from using the pool, jacuzzi and thermal areas.
33. Contents must be removed from lockers after use
of the facilities.
34. All children must be under constant
supervision by a parent or guardian whilst in the Spa and Wellness. The carer
must remain in a safe distance from the child ensuring visual contact of the
child at all times. Children that use the pool area are the responsibility of
their parent or guardian.
35. Children are permitted in the pool between
the hours of 10.00am – 12.00 noon & 15.00 – 17.00. Children under the age
of sixteen are not permitted in the Sauna, Steam Room, Jacuzzi or gymnasium.

RELEASE AND DISCLAIMER:
I fully understand that the use of the spa and wellness is
at my own risk.
To the full extent permitted by law, I agree to release,
indemnify and hold Anantara The Marker Dublin Hotel and its
staff harmless from all liability, actions, debts, claims and demands of any
kind incurred whether arising under law or statute and whether arising directly
or indirectly from the use of the Spa and wellness including without
limitation, all liability for death or personal injury, loss or damage to any
property and all liability for indirect or consequential loss or damage
including with limitation, economic loss.
